Terms of Service

Effective date: June 12, 2026

These Terms of Service (the “Terms”) are an agreement between you and Owlview (“Owlview”, “we”, “us”), the operator of the Owlview websites and applications, including Owlview Cityscan and Owlview Studio (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Owlview is a real-estate site discovery and feasibility platform. It combines parcel boundaries, zoning designations, public records, and our own analysis to help you evaluate development potential, currently focused on the City of Dallas, Texas.

The Service is offered as an early-access product. Features, data coverage, pricing, and availability may change, be interrupted, or be withdrawn at any time as we develop the product.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You may register with an email address and password or by signing in with Google. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account.

3. Access codes and credits

Parts of the Service may be made available through access codes, credits, or similar mechanisms. Unless we expressly state otherwise, access codes and credits have no cash value, are non-transferable, may expire, and may be modified or revoked at our discretion, including where we believe they are being abused. They are a license to use the Service, not property.

4. Acceptable use

You agree not to:

  • scrape, crawl, bulk-download, or systematically extract data from the Service;
  • resell, sublicense, or redistribute the Service or its data outputs as a competing product or dataset;
  • share account credentials or circumvent access controls, credits, or usage limits;
  • reverse engineer, decompile, or attempt to derive the source code or underlying models of the Service;
  • interfere with the operation or security of the Service; or
  • use the Service in violation of applicable law or third parties’ rights.

5. Third-party data and services

The Service incorporates data and functionality from third parties, including public records from the City of Dallas and Dallas County (such as appraisal-district and zoning records), map data from the Overture Maps Foundation, and address search and geocoding powered by Google. When you use address search and mapping features, you also agree to be bound by the Google Terms of Service and acknowledge the Google Privacy Policy. We do not control third-party data sources and are not responsible for their accuracy or availability.

6. No professional advice

The Service provides information and analysis for preliminary research only. It is not legal, architectural, engineering, financial, or investment advice, and it is not a substitute for verification with the relevant city, county, or other authority. Zoning regulations, overlays, parcel records, and entitlement processes change frequently and are subject to interpretation, and the public records the Service relies on may be incomplete, outdated, or incorrect. You are solely responsible for independently verifying any information before relying on it, including before purchasing property, submitting applications, or making investment decisions, and for engaging qualified professionals where appropriate.

7. Intellectual property

We own the Service, including its software, design, analyses, and compiled datasets. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. Reports and exports the Service generates for you may be used within your organization and shared with your clients, partners, and advisors in the ordinary course of your business, provided they are not resold or redistributed as a standalone product. Public-record data remains subject to the terms of its government sources, and Overture Maps data remains subject to its open-data licenses.

If you send us feedback or suggestions, we may use them without restriction or obligation to you.

8. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Service, you consent to those practices.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ITS DATA WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWLVIEW AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES (INCLUDING DECISIONS MADE IN RELIANCE ON THE SERVICE), ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold Owlview harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service in violation of these Terms or of applicable law.

12. Suspension and termination

You may stop using the Service and ask us to close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections 5 through 11 and 13 through 15 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by email or an in-product notice, and will update the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.

15. General

These Terms and the Privacy Policy are the entire agreement between you and Owlview regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them, including to a successor entity we form or to an acquirer of the Service, in which case the successor assumes our rights and obligations under these Terms.
